Terms and Conditions

This is a translation for your convenience. In case of any discrepancy, the German version prevails.
1. Scope and operator
These Terms and Conditions govern the use of the hatwer.ch platform. The platform is operated by Arina Man, Frohburgweg 11, 6340 Baar, Switzerland («we»). By registering and using the platform, you accept these Terms.
2. Our role: an intermediary platform
hatwer.ch brings together private individuals, neighbourhoods, clubs and groups who want to temporarily lend or rent out items, or borrow or rent them. We are only an intermediary. We are not a party to the agreements made between users. We do not sell or lend any items ourselves, and we do not verify the identity or reliability of users or the condition of the items offered.
3. Registration and account
- You must be at least 18 years old and have legal capacity.
- You provide truthful and complete information when registering and keep it up to date.
- Only one account per person is allowed. Keep your login details secret. You are responsible for all actions taken through your account.
4. Listings
- You may only list items that you own or that you are entitled to lend or rent out.
- Descriptions, photos, price and condition must be accurate.
- Not permitted are items whose lending or rental is prohibited or restricted by law (for example weapons, stolen or counterfeit goods), as well as unlawful, discriminatory or misleading content.
- You confirm that you hold the rights to the photos and texts you upload, and you grant us the right to display them on the platform.
- We may remove listings and content that violate these Terms or the law.
5. Agreement between users
An agreement is made solely between the person offering the item and the person borrowing or renting it. Where an item is provided free of charge, the statutory provisions on loans for use (Art. 305 et seq. Swiss Code of Obligations) also apply; where it is provided for a fee, the provisions on rental (Art. 253 et seq. Swiss Code of Obligations) apply. The parties agree on the period, price, deposit, accessories, liability and insurance themselves. Payments are made directly between the parties. hatwer.ch does not accept payments and does not hold deposits.
6. Handover and return record
The platform offers an optional tool to record the handover and return of an item (agreement, condition, photos, confirmations from both sides). It serves as shared documentation. We do not review its content, assess damage or decide on questions of liability or compensation. A record does not replace legal advice. Questions about damage or disputes are settled between the parties themselves.
7. User obligations
- Use items carefully and as intended, and return them on time and complete.
- Do not pass items on to third parties unless the person offering them has agreed.
- Report damage, loss and delays to the other party without delay.
- Communicate respectfully: no harassment, no advertising or mass messages, no circumventing the platform’s security measures.
- Follow the rules for borrowers and the rules for lenders.
8. Liability
We provide the platform with reasonable care but do not guarantee uninterrupted or error-free availability. To the extent permitted by law, we are not liable for the conduct of users, for the content of listings, for the condition, damage, loss or late return of items, or for lost profits or indirect damage. Statutory liability for intent and gross negligence and for personal injury remains unaffected. hatwer.ch does not provide insurance cover. We recommend checking before lending or renting out an item whether a personal liability, household contents or other insurance covers the case.
9. Costs
Using hatwer.ch is currently free of charge. If we introduce paid features in the future, we will inform you in advance, and they will only become chargeable with your consent.
10. Suspension and termination
You can have your account deleted at any time by writing to us at was@hatwer.ch. In the event of violations of these Terms or the law, we may remove content and suspend or delete accounts. Ongoing agreements between users remain unaffected.
11. Data protection
How we process personal data is described in our privacy policy.
12. Changes
We may change these Terms. We will inform you of significant changes on the platform or by email. If you continue to use the platform after the announcement, the amended Terms apply.
13. Applicable law and place of jurisdiction
Swiss law applies. To the extent permitted, the place of jurisdiction is Zug. Mandatory places of jurisdiction for consumers remain reserved.
14. Severability
If any provision of these Terms is invalid or unenforceable, the remaining provisions remain valid.
